Staat van wijzigingen (zowel naar aanleiding van de zienswijzen als ambtshalve wijzigingen) behorende bij de vaststelling van het inpassingsplan Luchterduinen (Q10 ).
In eerdere stukken in verband met dit project is aangegeven dat het inpassingsplan wordt vastgesteld door de Ministers van Economische Zaken, Landbouw en Innovatie (EL&!) en van Infrastructuur en Milieu (I&M) en dat de vergunningenprocedure wordt gecoördineerd door de Minister van Economische Zaken, Landbouw en Innovatie (EL&!). Bij het aantreden van het nieuwe Kabinet pers oktober 2012 is de naam van het ministerie van Economische Zaken, Landbouw en Innovatie (EL&!) echter aangepast.
Daarom wordt hierna gesproken over de Minister van Economische Zaken (EZ). Indien er wordt terugverwezen naar besluiten van voors oktober 2012, dan blijft Minister van Economische Zaken, Landbouw en Innovatie
(EL&!) staan.
Regels
Artikel 1
Aanhef artikel 1: 'In dit plan' is gewijzigd in 'In deze regels';

Artikel 3
3.1 ais hemummerd naar 3.1;

Het bevoegd gezag kan door middel van een omgevingsvergunning afwijken van het bepaalde in 3.2 en toestaan dat in de andere daarvoorkomende bestemming( en) gebouwen en bouwwerken, geen gebouwen zijnde worden gebouwd, mits:
a. deze afwijkingsbevoegdheid wordt toegepast ter plaatse van de aanduiding "specifieke vorm van leiding- boren";
b. geen onevenredige aantasting plaatsvindt van het doelmatig functioneren van de hoogspanningsleidingen als bedoeld in artikel 3.1;
c. vooraf schriftelijk advies wordt ingewonnen bij de betreffende leidingbeheerder.
3.3.1 is hemummerd naar 3-4-1: in de titel is toegevoegd 'ligging kabel'. De tekst is aangepast naar: Bij de aanleg van de hoogspanningsleidingen zoals bedoeld in 3.1, moet voldaan worden aan de volgende voorwaardelijke verplichting ten aanzien van de ligging van de kabel en de wijze van aanleggen:
a. het hart van de kabel dient minimaal 3 meter van de bestemmingsgrens te liggen;
b. ter plaatse van de aanduiding 'specifieke vorm van leiding- boren' dient de aanleg van de hoogspanningsleidingen verplicht middels een gestuurde boring plaats te vinden;
c. de kabel dient op een minimale diepte gelegen te zijn, waarbij per gebied de volgende minimale diepten gelden:
i. algemeen geldt een minimale diepte van 1,2 meter, gemeten ten opzichte van maaiveld;
2. in afwijking van het bepaalde onder 1 geldt dat ter plaatse van de aanduiding "specifieke vorm van leiding - boren" een minimale diepte van 4 m geldt, gemeten ten opzichte van maaiveld;
3. in afwijking van het bepaalde onder 1 dat ter plaatse van de aanduiding "specifieke vorm van leiding - doorkruising duinen' geldt een minimale diepte van 9, 7 m geldt, gemeten ten opzichte van NAP;
4. in afwijking van het bepaalde onder 2 en 3 geldt ter plaatse van de aanduiding 'specifieke vorm van leiding- in- en/of uittredepunt' dat de diepte minimaal 1,2 meter moet zijn.
3.4.2 Voorwaardelijke verplichting flora en fauna Gelijktijdig met de aanleg van de hoogspanningsleidingen zoals bedoeld in 3.1, moet voldaan worden aan de volgende voorwaardelijke verplichtingen ten aanzien van flora en fauna:;
3.3.1 ais hernummerd naar 3-4-2 a;
3.3.1 bis hernummerd naar 3-4-2 b;
3.3.1 dis hernummerd naar 3-4·2 c hierin is gewijzigd 'geplande in- en uittredepunten open ontgravingen" naar 'aanduiding "specifieke vorm van leiding- in- en/of uittredepunt" en in de directe omgeving daaivan'
3.3.1 cis hernummerd naar 3-4-3 met de toevoeging: Gelijktijdig met de aanleg van de hoogspanningsleidingen zoals bedoeld in 3.1, moet voldaan worden aan de volgende voorwaardelijke verplichting ten aanzien van archeologie:;

3.4 is hernummerd naar 3.5;

Verbeelding
Aan de verbeelding is een aanduiding 'specifieke vorm van leiding - in- en/of uittredepunt' toegevoegd, alsmede een aanduiding 'specifieke vorm van leiding - duindoorkruising' om de minimale diepten per tracédeel te kunnen borgen. Het tracé is op verbeelding 1 ter hoogte van het strand aangepast.
De naam van het Ministerie van Economische Zaken, Landbouw en Innovatie is gewijzigd naar het Ministerie van Economische Zaken. Toegevoegd is de naam van het Ministerie van Infrastructuur en Milieu.
Besluit
In het besluit zijn tekstuele verbeteringen doorgevoerd. Verder zijn de volgende zaken verwerkt:
• De nieuwe naam van de minister van Economische Zaken";
• De naam van het Ministerie van Economische Zaken, Landbouw en Innovatie is gewijzigd naar het Ministerie van Economische Zaken;
• De zienswijzen en wijzigingen in de besluiten.
Toelichting
In de plantoelichting zijn tekstuele verbeteringen doorgevoerd. De wijzigingen op de plankaart en de regels hebben hun doorwerking in de plantoelichting gekregen. Verder zijn de volgende zaken verwerkt:
• Het nieuwe regeerakkoord;
• De diepte van de ligging van de geboorde kabel is aangegeven in meters onder NAP;
• Een aanpassing van de bouwregels in de vorm van een afwijkingsbevoegdheid middels een omgevingsvergunning;
